Trademarks identify and distinguish one seller’s goods and/or services from the goods and/or services of others. The test for infringement is whether your use of a design creates a likelihood of confusion on the part of the public. You cannot create products with a design that is likely to cause confusion.     If I record a song that was written by another artist, can I upload it to the site for streaming if I do not have permission from the copyright owner? This is a case where I have not plans to sell my version of the song and it cannot be downloaded from the site.

    If I upload a cover tune for streaming only and have no intention of selling the song...is this OK from a copyright perspective?
